Q. How long do I have to make a claim?
A. A claim must be made within 3 years of the negligent treatment or the date that you knew or suspected that you had suffered as a result of the negligent treatment and treatment of your condition.If a relative has passed away as a result of the negligent treatment a claim must be brought within 3 years of their date of death if this was caused by the negligent treatment.Where a claim is brought on behalf of a child the 3 year limitation starts to run from the child’s 18th birthday.If the Claimant is a patient who is assessed as not being capable of handling their own claim the time limit (limitation period) does not begin until the legal incapacity is removed.
